What happens to our assets and debts in a divorce? I had some property before we got married. We have been separated for a long time.
Each spouse's right to property depends on several factors, including but not limited to when the property was acquired, how it was paid for and whether you can trace the source of the funds to the separate assets of a single spouse. The court will assign each party's separate property to the proper spouse and then divide the marital property. How the court determines both depends not only on the law but also on your lawyer's ability to argue the law and document your claim.
Do I have to pay the other spouse's debt?
Your responsibility to pay bills that you believe belong to your spouse can depend on the nature of the debt, the terms of the purchase contract, when the debt was incurred, whether your spouse subsequently files bankruptcy, etc. Your rights will be best protected by a carefully worded agreement that takes into account as many contingencies as possible.
