What is probate?
The court "probates" a Last Will and Testament to determine its validity. If there is a Will, then the court appoints a Executor/Executrix (male/female) to carry out the instructions in the Will, transfer assets, address debts and all other issues. If there is no Will, then the court appoints an Administrator/Administratrix (male/female) to handle these duties.
How long does it take?
With small estates, the process can be over almost immediately. Otherwise it takes at least six months.
Do I need a lawyer?
A lawyer can answer your questions and prepare the court paperwork. A judge has to approve everything, so having an experienced attorney will help this process go smoother during the stressful time that follows a loved one's passing.
What documentation do I need?
Understandably, some of these documents may not be available at the time you see a lawyer or the first time you go to court:
- Certificate of Death
- All Wills and Trusts (even prior ones if available)
- Personal information of the deceased: full name, address, date of birth, date of death, social security number, Medicaid card
- The names, addresses and ages of the heirs at law and next of kin:
- spouse
- children
- grandchildren (if their parent is deceased)
- parents (if there are no surviving children)
- brothers and sisters (if there are no surviving children or parents)
- Real estate deeds, estimated value and amount owed
- Certificate of Title of any vehicles, estimated value and amount owed
- Bills for final medical, funeral and burial expenses, and receipts if paid
- All other assets of the deceased and the values of each asset
